Introduction

At SwingSync, we take your privacy seriously. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our mobile applications (iOS and Android), desktop applications, and our website located at swingsync.com (collectively, the “App”).

This Privacy Policy applies to all personal information collected by SwingSync (Innovative Sporting Platforms Pty Ltd) and ensures we remain compliant with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

What is “personal information”?

The Privacy Act 1988 (Cth) currently defines “personal information” as meaning information or an opinion about an identified individual or an individual who is reasonably identifiable:

  • whether the information or opinion is true or not; and
  • whether the information or opinion is recorded in a material form or not.

If the information does not disclose your identity or enable your identity to be ascertained, it will in most cases not be classified as “personal information” and will not be subject to this privacy policy.

What information do we collect?

The kind of personal information that we collect from you will depend on how you use the App. The personal information which we collect and hold about you may include:

  • Account Information: Email address, preferred username, and account profile details.
  • Golf Performance Data: Golf simulator data, on-course golf tracking data, swing metrics, and historical performance data synced from third parties.
  • Device and Usage Data: When you use our App, we may automatically collect diagnostic and usage data, such as your device type, operating system version, unique device identifiers, app crash logs, and how you interact with the App.

Local Storage of Third-Party Credentials

To provide you with seamless golf data analytics, the App allows you to connect and sync data from third-party services.

We do not collect, transmit, or store your third-party login credentials on our servers. When you log into a third-party service through SwingSync, your credentials are encrypted and stored strictly locally on your personal device. The App uses these local credentials to request your golf performance data directly from the third-party service to your device, before securely syncing that performance data (not the credentials) to our servers.

How we collect your personal information

We may collect personal information from you whenever you:

  • Register an account via the App;
  • Input or sync golf performance data into the App;
  • Interact with our support team.

We also use cookies on our Website and similar tracking technologies within our App (such as crash reporting tools) to enable us to tell when you use the Services and to help customise your experience. As a general rule, it is not possible to identify you personally from our use of cookies or basic diagnostic tracking.

Purpose of collection

The purpose for which we collect personal information is to:

  • Provide, operate, and maintain the App and your SwingSync account;
  • Analyse your golf data to provide you with insights and platform features;
  • Improve the App’s performance and troubleshoot bugs or crashes;
  • Provide you with the best service experience possible.

We customarily disclose personal information only to our service providers who assist us in operating the App (such as secure cloud hosting providers). Your personal information may also be exposed from time to time to maintenance and support personnel acting in the normal course of their duties.

By using our App or Website, you consent to the receipt of direct marketing material. We will only use your personal information for this purpose if we have collected such information direct from you, and if it is material of a type which you would reasonably expect to receive from us. We do not use sensitive personal information in direct marketing activity. Our direct marketing material will include a simple means by which you can request not to receive further communications of this nature (e.g., an “unsubscribe” link).

Data Retention and Account Deletion

We will retain your personal information only for as long as is necessary for the purposes set out in this Privacy Policy.

You have the right to request the deletion of your account and associated personal data at any time. You can delete your account directly within the App by navigating to the Account Settings menu and selecting “Delete Account,” or by contacting us at [email protected]. Upon receiving a deletion request, we will securely erase your personal information and golf data from our active servers, subject to any legal obligations to retain certain data.

Access and correction

Australian Privacy Principle 12 permits you to obtain access to the personal information we hold about you in certain circumstances, and Australian Privacy Principle 13 allows you to correct inaccurate personal information subject to certain exceptions. If you would like to obtain such access or request corrections, please contact us as set out below.

Complaint procedure

If you have a complaint concerning the manner in which we maintain the privacy of your personal information, please contact us as set out below. All complaints will be considered by our privacy officer and we may seek further information from you to clarify your concerns. If we agree that your complaint is well-founded, we will, in consultation with you, take appropriate steps to rectify the problem. If you remain dissatisfied with the outcome, you may refer the matter to the Office of the Australian Information Commissioner (OAIC).

Overseas transfer

Your personal information may be transferred to or stored on servers located overseas (for example, using global cloud providers hetzner) for hosting and processing purposes. It is not possible to identify each and every country to which your personal information may be sent. If your personal information is sent to a recipient in a country with data protection laws which are at least substantially similar to the Australian Privacy Principles, we will not be liable for a breach of the APPs if your personal information is mishandled in that jurisdiction. If transferred to a jurisdiction without comprehensive data protection laws, we will take reasonable steps to secure a contractual commitment from the recipient to handle your information in accordance with the Australian Privacy Principles.

GDPR

In some circumstances, the European Union General Data Protection Regulation (GDPR) provides additional protection to individuals located in Europe. The fact that you may be located in Europe does not, however, on its own entitle you to protection under the GDPR. Our App and Services do not specifically target customers located in the European Union and we do not monitor the behaviour of individuals in the European Union, and accordingly, the GDPR does not apply.
